These Terms and Conditions ("Terms") govern the sale of products and services by Oak Toy Box ("Seller") to the customer ("Buyer"). By placing an order, the Buyer agrees to be bound by these Terms.

1. Definitions

“Buyer:” The individual or entity purchasing goods or services from the Seller.

“Products:” The goods offered for sale by the Seller.

“Services:” The services provided by the Seller.

“Agreement:” The contract between the Seller and Buyer consisting of these Terms.

2. Agreement to Terms

By purchasing products or services from the Seller, the Buyer agrees to be bound by these Terms. The Buyer should read these Terms carefully before making a purchase. If the Buyer does not agree to these Terms, they should not proceed with the purchase.

3. Products and Services

The Seller provides detailed descriptions of products and services on their website. While the Seller strives for accuracy, they do not warrant that product descriptions or other content is error-free. All products and services are subject to availability, and the Seller reserves the right to discontinue any product or service at any time.

3.1 Nature of Wooden Products

Wood is a natural material, and variations in colour, grain, and texture are inherent characteristics that make each wooden product unique. These natural variations are not considered defects but are part of the beauty and character of wooden products.

3.2 Product Care

The Buyer acknowledges that wooden products require proper care and maintenance to preserve their appearance and functionality. The Seller will provide care instructions specific to the product, and it is the Buyer’s responsibility to follow these instructions. The Seller is not liable for any damage resulting from improper care or maintenance by the Buyer.

3.3 Environmental Conditions

Wooden products can be affected by environmental conditions such as temperature, humidity, and exposure to direct sunlight. The Buyer should avoid placing wooden products in extreme conditions or environments that could cause warping, cracking, or discoloration. The Seller is not responsible for any damage caused by environmental factors.

3.4 Returns and Exchanges

Custom and personalised wooden products including but not limited to engraved items or any product that has been modified or tailored to the Buyer’s specifications are made to the Buyer’s specifications and are non-returnable and non-refundable unless the product is defective or not as described. The Buyer should review all customisation details carefully before placing an order. The Seller is not responsible for any errors in customisation details provided by the Buyer.

If a personalised product is deemed by the Buyer to be defective or not as described, the Buyer must notify the Seller immediately. The Buyer must provide a detailed description of the defect or error, along with photographic evidence. The Seller will review the claim and, if the product is found to be defective or incorrect, will offer a replacement or a refund. The Seller’s liability in such cases is limited to the purchase price of the product. The Buyer is responsible for return shipping costs unless the product is faulty or not as described.

3.5 Sustainability

The Seller is committed to sustainable practices and sources wood from responsibly managed forests. The Buyer is encouraged to support sustainability by following the care instructions provided and considering the environmental impact of their purchase.

3.6 Warranty

The Seller provides a lifetime warranty on its wooden products against manufacturing defects. This warranty does not cover normal wear and tear, damage caused by improper use or care, or environmental factors. The Buyer should retain proof of purchase to make a warranty claim.

3.7 Order Confirmation

Once an order for a personalised product is placed, the Buyer will receive an order confirmation via email. It is the Buyer’s responsibility to review the order confirmation carefully and ensure that all details are correct. Any errors in the order details should be reported to the Seller immediately. The Seller is not responsible for any inaccuracies in the order details provided by the Buyer.

If the Buyer  wishes to alter or amend an order, they must do so within 24 hours of the order being placed by phone on 0744 9794050. After that it may not be possible to make any changes without additional costs. A full refund will be made if the cancellation is received within 24 hours of the order being placed. If the cancellation is received more than 24 hours after the order was placed, a refund in part or in full may be made at the Seller’s discretion.

3.8 Production and Delivery Time

The production time for personalised products may vary depending on the complexity of the customisation and the Seller’s current workload. The Seller will provide an estimated delivery date at the time of order confirmation. While the Seller strives to meet these estimated delivery dates, they are not guaranteed, and the Seller is not liable for any delays in the production or delivery of personalised products.

3.9 Approval of Design

For our personalised products, the Seller will provide the Buyer with a proof or mock-up of the design for approval before production begins. The Buyer must review and approve the design proof within the specified timeframe. Any delays in the approval process may result in delays in production and delivery.

3.10 Returns and Cancellations

Due to the customised nature of personalised products, returns and cancellations are not accepted once production has begun, unless the product is defective or not as described. If the Buyer wishes to cancel an order for a personalised product, they must contact the Seller on 0744 9794050 immediately. If the cancellation request is received before production has started, the Seller may, at their discretion, issue a refund or credit.

3.11 Intellectual Property Rights

The Buyer warrants that they have the right to use any text, images, or other content provided to the Seller for use in the personalised product and to photograph and display such personalised products for the purpose of promoting its goods and services. The Buyer agrees to indemnify, defend, and hold harmless the Seller from any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with the use of such content in the personalised product.

3.12 Personalisation Limitations

The Seller reserves the right to refuse any personalisation request that is deemed inappropriate, offensive, or otherwise unacceptable. The Seller will notify the Buyer if their personalisation request cannot be fulfilled and may offer alternative options.

4. Pricing and Payment Terms

Prices for products and services are listed on the Seller’s website and are subject to change without notice. The Buyer agrees to pay the price specified at the time of purchase. Payment must be made in full before the shipment of products or the provision of services. Accepted payment methods include credit card, debit card, and other methods as specified on the website.

5. Shipping and Delivery

The Seller will arrange for the shipment of products to the Buyer’s address as specified at the time of purchase. Shipping times are estimates and not guaranteed. The Seller will contact the Buyer to notify them of an imminent delivery and the shipping carrier will provide the Buyer with a date and approximate time of delivery. The Seller is not responsible for delays caused by the shipping carrier or any other unforeseen circumstances.

The Buyer must be home on the notified day to sign for delivery. The shipping carrier will not be responsible for carrying the toy box into the Buyers home and due to the weight of the shipment – up to 27kg - the Buyer is advised to have assistance on hand to transfer the crate from the carrier’s vehicle. Risk of loss and title for the product passes to the Buyer upon delivery.

The Buyer is responsible for ensuring the safety of all persons coming into contact with the Product and the Seller accepts no responsibility for injury caused to the Buyer or third parties known or unknown to the customer as a consequence of handling or use of the Product.

The Buyer is advised to open the crate and inspect the contents upon receipt and to notify the Seller immediately if any damage has occurred in transit. No claims for damage will be accepted after 24 hours and all packaging must be kept if any returns are to be made. The Seller is not responsible for any loss in transit.

6. Warranty and Liability

The Seller warrants that the products will be free from defects in material and workmanship for a period of 12 months from the date of delivery. This warranty does not cover damage caused by misuse, neglect, or improper installation. The Seller’s liability is limited to the purchase price of the product. The Seller is not liable for any indirect, incidental, or consequential damages.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to Terms

The Seller reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Seller’s website. The Buyer is encouraged to review the Terms regularly. Continued use of the Seller’s services constitutes acceptance of any changes.

9. Data Protection and Privacy

The Seller is committed to protecting the privacy of the Buyer. Personal data collected during the purchase process is used solely for fulfilling orders and will not be shared with third parties except as necessary to complete the transaction or as required by law.

The Buyer agrees not to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Seller’s content without express written permission from the Seller.
  • Use the Seller’s content for any commercial purpose or any public display (commercial or non-commercial).
  • Remove any copyright or other proprietary notations from the Seller’s content.
  • Transfer the Seller’s content to another person or “mirror” the materials on any other server without express written permission from the Seller.

10.4 Reporting Copyright Infringement

If the Buyer believes that any content on the Seller’s website infringes on their copyright, they should notify the Seller immediately. The Seller will take appropriate action, which may include removing the infringing content or disabling access to it if it is determined that an infringement has occurred.

10.5 Infringement Claims

If the Seller receives a claim that any product or service infringes upon any third party’s copyright, the Seller reserves the right to, at its sole discretion, replace or modify the product or service to make it non-infringing, or to terminate the sale and provide a refund to the Buyer. The Seller’s liability in such cases is limited to the purchase price of the product or service.

The Buyer agrees to indemnify, defend, and hold harmless the Seller, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with the Buyer’s use of the Seller’s copyrighted content in a manner that violates these Terms or infringes upon any third party’s copyright.
